If your sister has a 5 year ban on entering the United States, then she cannot enter the United States for five years. If she attempts to enter the United States during that period, she will receive a 20 year ban. If she illegally enters the United States during her 5 year ban, she will be banned for an additional 20 years and can be prosecuted (that means put it jail, prior to being deported). She should not attempt to enter the United States until she gets a visa.
What she can do is apply for some status at the American Embassy in Canada. She may be able to get a waiver there. In any case, she must get a visa for any future entries into the United States.
As for those who think the story does not make sense, it absolutely does. She was probably refused entry as an intending immigrant without an immigrant visa (see why she may have lied regarding her marriage?).
Whether she is pregnant or not, and whether she has American citizen children or not, does not make the least bit of difference.

This is an amazing story. Just that. A story, unless you're willing to tell what's really going on, there's no way to give you a legitimate answer. All that aside, this country takes it's borders seriously. You DO NOT lie to border patrol officers. That must have been the penalty [and with good reason] for lying in the first place. I just wonder how they "knew" they were married. Were they sooth sayer officers? Psychics? What? That is just too bazaar.
To have a baby takes oh, so much more than to get across any border. They are talking about procreating. Bringing a life into this world. But, just to get across the border? That is really sad. As far as I'm concerned they're frauds and should NEVER be allowed to have kids, let alone the privilege to enter American soil.

Immigration does not get sped up because of a baby that is half American. In fact, the baby can be born in Canada and can register for American citizenship until the child is five years old, so the baby is not in any danger of losing his/her American citizenship if he/she is born in Canada.
Why would your sister and her husband lie to border patrol in the first place? I mean, your sister has heard of the ongoing war against terror, right? I'm not wanting to be nasty, but she's probably going to have to wait out the five years and just remember not to do that anymore.
Her husband can return to Canada to live with her and can perhaps help grease the wheel a little bit IN CANADA through its government and with the American Embassy.

Americans are not racist, what it comes down to is that they want the welfare of their country just as much as the next country. The thing is that they are mislead by many irrational points that contradict each other like: They take away our jobs, when the truth is that they keep our jobs here, because american labor is so expensive that companies rather go to china and central america where the labor is cheaper, thanks to the cheap labor of immigrants many companies stay in the U.S. why cant they come here legally like other immigrants: well most illegal immigrants come from countries where money per capita is so low, the U.S don;t give them the opportunity to come here, it's only countries like in Europe and Japan where immigrants with high income can come here with no problems, other people are only given the chance to come here for 6 months. I believe Americans need to get better informed by looking at the other side of the picture, if you want to have an opinion on this subject you need to see both sides not just one.

most people on here are correct... getting pregnant will make no difference.... immigration don't care if she is pregnant..... will make not difference to them, and nor does her marriage to a citizen change her status, she needs to apply for a visa or residency....
but because she lied at the border i would suggest she contact a lawyer.... she may be in some big trouble... just because her husband is a citizen does not allow her into the country all the time... tell her don't get pregnant unless her husband is willing to stay in canada until she is permited into the usa....

Why would she deny being married when crossing the US border? Makes no sense.
And being pregnant doesn't help at all. Neither does having a US born child.
She is married to a US citizen, right? Then she'll eventually get US citizenship.

the baby has to be born IN the usa before it can be called an american baby, regardless of whose it is.
plus why would they lie about being married? it would help things out here, i can figure this out if you give me more info.
i am an american citizen and i live in canada because thats where my baby was born, but i can take her back with me if i like, i just found i can be closer to my brother if im here.
and my mom is canadian, but works with immigration and government houseing. my uncle works at the american border. ill try to help if i can, just ask me for my email if you want.

It won't make a difference if she gets pregnant. You're right, she'll end up alone and pregnant in Canada. She shouldn't of lied in the first place.

the best way for her now is to enter illegaly, like many of us, and stay in USA or see an attorney, who will fix the problem from inside...guys at the custom, are stupid...
and as u are neighbour country, just a good walk in the field for 4-5 hours, would be easy.

No, it does not make a difference. The only difference would be if she had the baby in the US, the baby would be a US citizen. On the other hand, they could still deport the mother regardless of her childs' citizenship.
