i was driving in jersey city, nj and while merging on highway i stopped at stop sign, the bmw behind me hit my car at stop sign ignoring the stop sign, i called 911 the cop came . i felt the cop being rational and argued with me regarding the damages. i still dont have the police report but what is i found the police report based on rational descrimination.

i was not in fault as it was rear end accident at stop sign .
mine was 93 altima and the person who hit me from the back was having brand new bmw.
can n e one suggest me what further steps i should take after i receive police report and what i should do if i found the police report biased.

If the cop was rational what was the problem? You're just taking a beating on your spelling, aren't you?
Seriously, are you asking "what if" questions? You haven't seen the police report? What don't we know about this accident?

Now that the interrogation is over...the police report is one thing that figures into a liability investigation by an insurance company. Police officers do not make liability decisions. They are there to determine if someone violated a rule of the road or should get a ticket, but what they say does not end up being the only piece of evidence. And whether someone got a ticket does not determine liability or whether your company will pay for damages to someone else if you got one, etc. They handle the criminal side of an accident, and insurance companies deal with the civil end of it. The insurance company will get all the facts and evidence. However, sometimes, when there is a dispute over certain facts and the only thing that can really weigh into evidence to support one of the people is the police report, they may have to go with that. You can let the company know about the problem.

Some people even go so far as to file a complaint against the officer, but I have never seen that result in an officer amending a police report. Also, there are times when it's pretty clear that the allegation of racial bias is a smoke screen to deflect fault. Let your company handle it. But if you haven't seen the police report, why worry about it right now?

Here's the CORRECT answer, although you likely don't want to hear it.

For starters, it's called "racial discrimination", not "rational descrimination". Learn to spell and use grammar...please.

Second, in a rear end collision, the person who hit you from behind is the person who is going to get the ticket. And it doesn't matter if he was driving a BMW or a Chevy or a piece of crap Nissan. And it doesn't matter what car you drive either. You didn't get a ticket (otherwise you would be whining about that too), so the cop obviously wasn't discriminating against you. If he got upset with you it wasn't because of your race...it was probably because you were in his face arguing with him, while he was merely trying to do his job.

Another thing...if you don't have the police report, then how the heck would you know whether it is biased or not? Answer? YOU DON'T, and it isn't. Yes, the guy hit you, and yes, it's not your fault, but it is nothing more than that. Stop trying to turn it into a race issue, because it isn't and you know it. You are just angry and trying to turn this into some way of making profit from the situation because the other guy drives a nice car, and that's not going to happen so don't waste your time.

Stop playing the victim... the other guy's insurance will pay for your damages, and you will get your car fixed. Move on with your life. And stop trying to play the race card.

You need to obtain a copy of the police report. You should have a case number or Officer to refer to.
Are you even sure a report was made?
Normally a report isn't even done - unless there are injuries.
An ST-3 or similar form is done if there are major damages..but a "report"?

If it exists the police aren't trying to keep you from it - all you have to do is request a copy.
Then, as someone else has already suggested - give a copy to your insurance company and file your claim.
What did you expect the cop to do? Arrest the guy in the bmw?

I'd like to know how you came to the conclusion that the report is based on racial discrimination - when you havn't even seen it.

Another thing..I get the impression that maybe you have a bit of a chip on your shoulder..
The cops discriminated because you're driving an altima..c'mon man - what does that have to do with racism?

At this point the police probably won't file a report - and if they did - they would record your version, the other person's version - and then record the witness's name. You wouldn't be any further than you are now. If the other person tells a different version and their insurance company won't accept the witness's version - you should use your insurance, and then they will go after the other insurance company for their money and your deductible. Or - you could sue them in small claims court if you don't want to get your car repaired right now.. It could take a while to get the case heard.

Don't worry about what if's. Just report the accident to your insurance company and have them investigate the accident and repairs to your vehicle.
If you wish to handle it on your own then get the insurance information on the other driver and report the accident to them to handle the repairs to your vehicle.
If this is indeed a simple rear end collision then the other insurance company will pay for the damage to your vehicle and get you in a rental car during the repair process.

You sound like you may have pissed the police officer off however, a rear end accident is 99% the fault of the person who hit the other in the rear so quit sweating the load unless you did something illegal. ie..... changed lanes suddenly and locked the brakes????

make sure you get a copy of the police report. call an attorney and see if they will give you some free advice over the phone. I am sure there will be some sort of court date in your future so make sure you state your case the way you think it went down
