You have to get the marriage license in the state where you are going to be married. For NY, there is no waiting period between applying and receiving the license, and a 1 day waiting period between receiving the license and using it. The license is then valid for 60 days. So you would need to both go together to get the license the day before you want to be married for NY. Please see the chart linked below if you want to be married in another state.

If he is serving overseas or has definite reasons why he can't come home (active duty normally does the trick), there is a way to get married by proxy. He won't be at your "wedding", but you can get married with a fill-in husband. It is so not romantic, but there have been tons of marriages this way, especially back in the day when a pregnancy was involved. What you would have to do is call the county clerk's office and see what the rules are. If they say you can't do it, then call a lawyer specializing in family law. They can help you. Then, most likely, your fiance would have to sign a notarized form and mail it back declaring that X was his proxy. Then you and the other person (normally his best man), go get a marriage license and then go to the JOP or Minister/Priest/Rabbi and get married. It is great if you can set up a video feed so your hubby can participate. Then you are officially married. When your hubby returns you can have a real wedding, which is technically a renewing of the vows. I recommend getting married ASAP so you can get the benefits of being a military wife and so you don't have to play this guessing game. Also, you can plan your wedding based on his leave, but you never know when that will change. One of my classmates had a major wedding planned only to find her fiance was shipped out the day before their wedding. This was on 2 weeks notice!

Good Luck!
