hey guys,i live in NY with my bf and he got a speeding ticket for doin 87 in a 55mph... the cop gave him 3 pts off his license on the ticket. They said he MUST appear in court even if he were to plead guilty and just pay the fine. Wats gonna happen? Will he get his license suspended? How much would the fine be? This is his first ticket ever.

First of all, I want to advise you to seek the advice of a local attorney who specializes in traffic law. Your boyfriend has a number of options. Pleading guilty as charged WILL result in points being assessed against his license. If he has an otherwise clean driving record, an attorney, or your boyfriend, may be able to persuade the DA to amend the charge to a non-point speeding violation (usually 1-5 miles over the posted limit) or suspended the conviction providing he pays a "shock fine" and/or completes a period of "traffic probation"; meaning no further traffic tickets for 90 days to 2 years. He may also have to complete a defensive driving class or do some community service. Traffic tickets, like most criminal cases are negotiable and I urge you to negotiate. You have options and rights in traffic court, just like any other court of law. Explore them.

I am 99% that he will not lose his license or get it suspended. for a first ticket and going that fast it isn't the biggest thing in the world. If it says 3 points on the ticket then it's gonna be either 2 or even 1 when he see's the prosecutor. I got a ticket 2 weeks I got my license and I was going 79 in a 35 and I was only 16. I paid $450 because it included a modified part on the car and I got 4 points on my license. I got another speeding ticket and I still didn't lose my license. All I did was go show up and pay the fine. Im not proud of what i've gotten but im just giving you examples of how mine went. Just try to slow down a little bit and if there is need for speeding then make sure you REALLY know how to drive safely at that speed and memorize exactly where cops will be and hide. I know every single spot where a cop sits and I can go 100 over the speed limit and I wouldn't get caught, I don't go that fast because there is no need to risk lives for a little excitement for just one guy. Negotiate nicely and if you want to beat it try getting this Guide. I beat 5 tickets with this handbook so its very helpful. Good Luck.

The reason he MUST appear in court is that anything over 20 mph over the posted limit is criminal traffic offense. He could lose his license for a year, or get a rather huge fine.

With it being his first ticket, they aren't really going to look at that. He was going 87 in a posted 55 mph zone. Not only is that a blaintent disregard for the laws of the state, but unsafe to himself and other drivers on the road. There is a reason for speed limits.

From what I have seen/heard, he will more than likely have his license suspended. During that time, he would have to prove that he has insurance to be able to get a work restriction license (allowing him to drive to and from work only - anything beyond that equals driving on a suspended license and could result in time in jail and /or longer suspension).

I am a little confused by your question...the police do not give points,they are assigned by the court and it is sometimes open to the judges discretion to assign less points by knocking it down to a lesser charge . According to the NYS DMV points system he will be assessed 8 points if convicted which will not result in suspension...are you sure he does not have other tickets on his record? the fine can vary depending on the court it is returnable to..

11 points in 18 months still results in DMV license suspension/revocation hearing. Points are assessed as of violation date.
Three speeding violations in 18 months still result in mandatory license revocation, regardless of points.

I have had a couple tickets dropped before. I live in Washington State, and they had a story on one of the news channels about how to beat a ticket. I do not know the laws in NY, but I can tell you what to look for.

Make sure that the information on the ticket is accurate. I had a ticket dropped because a second officer that was not at the scene signed my ticket. If the officer paced your friend you can have a lawyer fight that pacing can be inaccurate. That was another ticket that I was able to get dropped.

I pay for lawyers each month for a small fee so if I were to ever get a ticket, they appear for me in court. Your friend can call an attorney to get advice.

What should you do? Pay the fine. And if his license is suspended, learn to walk. Maybe the bf will learn from the experience and know better next time.

Read the back of the ticket. An "appearance" may be as simple as walking in with the ticket and cash. I hope he loses his license and then you dump him.

Pay the fine, tell him to drive slower to avoid this kind of thing in the future. Driving is a privilege, not a "right."

He was really driving too fast. He is lucky the police stopped him.
