I'm not sure of the legal ramifications of this particular question since it is more of a moral one I believe. It comes down to this: are you a moral person? Are you going to take something that doesn't belong to you? Are you going to justify it as since it's in your vehicle it's now yours, possession is 9/10ths of the law, etc? Those are the questions that you really need to ask yourself.
1) Is there going to be some sort of legal ramification to cashing this check? Will you somehow get in trouble?
2) Will you be able to accept knowing that the money was not really yours?
Hey if you can get away with it physically and mentally and sleep at night go for it. That's 5k in your pocket. Though remember that if you cash the check you'll put your name on it and the person who wrote the check could see who cashed it through their bank. If it was a business transfer or personal check or what have you it may come back to haunt you if they find out you lied.

That is up to you but they will be able to trace it to you and if you do not have any proof that the check was meant for you. Then you will spend that much money in court cost and legal fees. I would give it back if he knew it was there it must be his. I think you could get a few years for theft or fraud if you cash it. If it was cash money I would say it is yours.
