If you are driving with a open container, and when pulled over you blow under the legal limit. What is the maximum that the police can get you for?

What i am going for is if you just picked up a 6 pack and open the first one and start drinking it on the way home, what can they get you for?

It can vary so much it is hard to say. For instance in Panama City Florida during Spring Break last year a friend of mine got sited for "public" open container charge, it cost $25, a mail in fine.

In Georgia? Suspected open container (not even proved) cost my roommate $200, a day in court plus court costs. The officer "said" and told the judge he saw an open container in the car, NOT true, but she paid the $200.

It is up to the judge what he will charge. It is the officer's statement that will be taken into account.

In most states, if you have an open container in the front seat, that's enough to ticket you for that offense. If the six-pack was unopened but within reach, some states will even ticket you for that. So keep it in the back seat while transporting it to be safe

Just open container ticket.The thing I can't figure out is if you have a designated driver you still can't have an open container in the vehicle.

Driving with open intoxicants in the vehicle. I believe that is a ticket, and could cost you when time for insurance renewal rolls around.

are you a minor, if not you can still get OUI operating while under the influence, open container, in MA you would lose your license most likely
