My ex and I were involved in a domestic violence situation. he was in jail for 4 months.. He had a pre-trial conference that he didn't show up for so they post poned it, and he didn't show up for the post-poned one either.. now I see on the courts website that he has a bench warrant out for him, and that his trial is set for october.. Does this mean they are going to arrest him and keep him in jail until october?

The best way to explain a bench warrant is that no extreme ways of arresting him will occur. If they are questioning him regarding anything, if he gets a traffic ticket, if they just happen to recognize him, they will arrest him. After the arrest, he will have an arraignment on the charges and a bail will be set. They will most likely not keep him until October, due to the current overcrowding in this country, unless he committed a felony DV.

when someone fails to appear in court the judge places a pick-up order or bench warrant on them so if they are caught they go to jail now and until they see the judge and this reflects on their case so if he does get caught then he needs a lawyer bad as a lawyer can use the time on the warrant that he does in jail as part of the sentence in my state the second domestic violance charge is a felony with a mand atory sentence and loss of rights like having a gun or voting sometimes if you know where he is have him go down to the court house in the morning and take his lawyer or a legal aid with him and turn himself in for thats the best outcome if caught some other way they may stack charges on him to make sure he does time

They could do that. At the very least they will arrest him if he gets stopped for anything else. Or they may send officers to his home and arrest him. If he didn't show up for court before they will probably make the bail so high that he ends up staying in jail until the court date.

Get a lawyer, check on a public defender. He will have a bail amount set, but given the fact that he has already done foir months might mean it can be resolved quickly, if he is willing to plead guilty. Otherwise its wait for a trial date.

It means that they issued a warrant and that if they catch him, he will be arrested. Now they can set bail, for him, so he could get right out most likely.

why are you concerned ,you should be happy...if someone was beating me up I'd want to see them in jail...and the bench warrant means..if he ever gets stops for anything....he's going to jail..
