I do not think that it is allowed under Florida law. Regardless of what anyone says. You can challenge any lien in court. Do not believe they are lawyers. The Collection agency can be rude and demanding and don't let the use the scare tactics on you. I saw a report on this last night and how aggressive a collector was to a Judge and he was not even his debt. Collectors are not allowed to do this it is against the law according to the news. They can not be threatening.

There are two different types of homestead exemption in Fl. One is for taxes, the other is for money debt judgments. You need to file an affidavit of homestead, which is "not" the same as homestead exemption for property tax.
Doing that, your home will be exempt unless it is a tax lien, child support, federal lien, mechanics lien etc
If you are working your salary can be garnished, but if you can file a statement with the court that you contribute over 50% to the support of your household, you would be considered "head of household" and you will be exempt from garnishment.
If you file the certificate/affidavit of homestead, your home will be totally exempt.
Go to the first link I've provided. It has all kinds of links to your states statutes etc. **There is also a link on filing the homestead exemption that you need to stop a lien.
You might do some reading in the second link also.
Use the search bar located at the top of the forums. Enter - "florida" and "homestead" - and then click on all forums. There is tons of info on there about law suits, exemptions etc for Florida.

Contact a attorney yourself even if just for a free consult and let them give you advice on what you should do.

They can do anything they want. Don't think by filing a piece of paper gets you out of paying your debt.

You bet they can, why don't you just pay your bill? Let me guess, you got sick, you lost your job, a friend stole your credit card, blah, blah, blah! You ran the bill up, now do the responsible thing and pay it! Don't bother to email me nasty messages, I have heard them all!
