while we were seperated the credit card company sent checks in the mail that would apply to the credit card, well, not knowing the account was already closed i spent about $1000.00. if the account was already closed and we never asked them to send the checks, and im not actually authorized to use those checks, can these charges be disputed by my husband not to pay them because he didnt actually use them, i did, not knowing i wasnt authorized to use them? its a capital one in ga.

When they attempt to charge these accounts to the card they will get notified that the credit card has been cancelled. You will probably get a call or a statement in the mail concerning your accounts asking for you to update your billing information, but you're hubby will not be taken to jail. At most your accounts with these companies will be cancelled.

You say seperated does that mean u r still together?? I am sure you won't go to jail they are just going to come after u to pay if you name was on the account and the checks how were u to know.

Well, they would have had your husband's name on them so you're telling us that you forged his signature on the checks, right?
You bet your sweet bippy that your hubby can dispute them! But he's going to have to file forgery charges against you to get off the hook. And given the amout, it's going to be a nice fat FELONY!
If you were MY old lady, I'd predict both a divorce lawyer and come crimminal charges in your very near future!

if the account was really closed, the checks would never clear...
the only way not to pay would be to report a fraud, and to do that your husband would have to sign a notarized affidavit....
there would be investigation, and I would strongly advise against forging the document or trying to scam them.

You and him are still responsible for your debt. It's not the credit card company's fault. If he files against you, you can be charged for fraud. Pay the debt.

You spent the money...they could probably sue you for fraud for using checks you weren't authorized to use. I'd just pay it back.

If you don't have permission to use any credit card that is not yours. people should leave it alone because that is called fraud
