The charges are misdemeanor as they are not felonies. You might need to speak with an attorney. The most I see happening is a fine, probation, community service and the suspension of his drivers license until he is 21 years old or attends a drivers improvement class.

Your hysteria is evident in your posting of your question.
Firstly, your son is 21 years old. He's a boozer and a pothead.
How much of this is because you let him get away with a lot of bad stuff because of the tragedy of losing your other son. (I'm REALLY sorry - I don't know how I could live with that.)
Make sure he has a lawyer. YOU are not responsible for this - he is. If he's not working, as I suspect, he will be entitled to assigned counsel, free.
If this is his first offense - the charges, based on your somewhat muddled description, appear rather minor in the grand scheme of things. He should make out just fine - although a good kick in the *** would be good for him.
I'm not saying I would do anything different - but I reckon you and your wife are "enabling" him to get away with this stuff. Does he work? Does he still live at home? Did he graduate from High School? How does he afford a truck, beer and weed? Are you giving him spending money?
When YOU were 21 was someone providing YOU with all this stuff? Time for Sonny to grow up and be the man that he is.
I sure hope that you and your wife and any other children you have are receiving family counseling. PLEASE, PLEASE do this. I can see the desperation in your question. He's using your fear of losing him to use you. The way to SAVE him is TOUGH LOVE. The ONLY thing I'd do for him now is make sure he has a decent lawyer.
How many times has he said to his mother: "If you don't do this for me, I'll kill myself?"
PLEASE - get help for your family - and throw Sonny out. Enough - save your wife and yourself.

It's a misdemeanor, not a felony. The problem is the drugs and alcohol, not the charges. Please deal with the real issues, and don't miss your opportunity to help your son NOW, by letting him deal with the (minor) consequences of his actions. He, and you, need counseling. Erasing the charges won't help him.

You should consult an atty. or a paralegal, even a court assigned atty. Don't trust something so important to a panel such as this, this is too important of an issue.
