How a father obtains legal custody of a child

2006-08-21 04:28:57 · 9 answers · asked by Jennifer R 1 in Family & Relationships Family

My brother is currently incarcerated with less than 54 days to go until his release. the mother of his child has let the child go to her mother and sister. Our family hasn't seen the baby since the end of June. When my brother is released from prision, what does he need to do to be able to go and get his daughter. His name is on the birth certificate as the father. I am in desperate need of help so I can get the ball rolling for him if I can. Thanks

He has to go to the court where the divorce was granted with documentation prepared by a lawyer. Specifics depend on the case.

Go to the courthouse and buy a packet of papers and take them to the family law facilitators. They will make sure the papers are filled out completely (by you) and get you a court date.
