My 12 year old sister lives with my mom, he dad died when she was 1, my mom is going to jail here shortly and I would like to take my sister in. In order to put her in school I heard I need to be her legal guardian. How do I go about this and does our mom have to give consent, if she does not give consent will my sister be sent to foster care, even if she has family members that are alive??

Foster care/ Family services usually look first for immediate family member in placing kids. If you're mom is willing, it's a simple matter of her signing a Power of Attorney giving you the right to act In Loco Parentis, in place of herself. You can get information at legal aid, Family Services or your local court house.

In most cases, the courts would rather see a child with family then in a foster home. I would call a lawyer with your mom and get advice regarding your little sister. You deserve a huge pat on the back for being mature enough to stand up and take the place of your mother for your sister. I hope that everything works out for you and your family. Take Care

If your mother cannot see that it is in the girl's best interest to give you consent, you can petition the courts to force the matter. If you are a suitable guardian, she doesn't have to be sent to foster care.

I think you have to contact a lawer and and child services, and I doubt your mom has to gibe consent, Cause, I don't think they cared if she gave consent to take your sister away. I am going to think you you have to be a certain age I gueass probably 21 at least, and you have to have to have enough money to support a child, and you have to have a job.
