Abandonware is software that hasen't been on sale in quite some time & can no longer be obtained through legitimate shops. Why therefor do most companies & the ESA consider it to be illegal & in the same league as real pirate software?

Copyrights take a lot of time before they die. In the case of books, it takes almost a century before the rights are no longer valid. I don't know if it's the same for software, but I do know companies may renew the rights for their material.

Additionally, games have been known to appear on compilations, and so if they were available for free over the web, it would devalue the product.

Because it is still copyrighted. Even if the company which produced it no longer exists, someone will still own the copyright..
