the reason i ask is if you where to be busted as well you may not get into the car and the driver may just leave it and if the diver dose crash he or she may not have any one sitting beside them

yes RJ but should a passenger be busted as well i dont drink and drive as i dont drive

Yes, you SHOULD be busted as well. If you KNOW the driver is drunk, and you encourage him to drive anyway (since you want him to drive you home), then you will be as much at fault when he kills someone as he is.

This should be a no-brainer.

Call a taxi for the both of you.

If you are that concerned about the person's safety, there are other options than encouraging their dangerous behavior. Take them in your car. Get a friend to take them. Call a taxi. Or how about this: Instead of getting in the passenger seat, get them to hand you the keys and you get in the driver's seat. If you are driving, then the person who is drunk will not crash into anyone. That would solve the whole problem right there.

If you just hop in the passenger seat, you are letting that person risk their life, the lives of every person on the street, and your own life. You are encouraging their negative, dangerous, and illegal behavior. That's what a designated driver is for, to stop all that. Do the right thing!

It is not a crime to RIDE in a car with a drunk driver. It is only stupid.
