Hi! This is in regards to my previous question about indictment. Basically my boyfriend got arrested and charged with AGGRIVATED ROBBERY. The reason was he went to a store in the mall and put a bottle of cologne in his pocket to steal (yes very stupid), he winded up chunking the bottle before leaving the store and he left and got in his car and was backing up when the store manager, who had been following him, ran up to the car and grabbed his shirt collar and steering wheel causing the car tires to turn. The car was already in reverse and the car kept moving. My boyfriend continued to back up and drove away because he was scared. COme to find out, when he backed up, he ran over the man's foot. They arressted him the next day for aggrivated robbery. The store manager has admitted in a written statement that he did indeed grab his collar and steering wheel. THe police searched our house looking for the cologne and of course didnt find it. Will this charge stick? Dallas, Texas

Hey you guys, my boyfriend is not a loser. He has never done anything like this before and he has been going through a real tough time right now and that's why he felt he needed to steal. I did not say that he was not in the wrong, he definitley is and that i why I am not bailing him out right now, but I dont think he is guilty of aggrivated robbery.

He did chunk the cologne before he left, he took it and figured out that was so stupid and chunked it. He is a total paranoid square and he couldn't believe he attempted to take it in the first place. YES his dumb mistake lead to this whole fiasco and he will have to pay. I just hope they dont blow it out of proportion.

I am going to stick by him because he is absolutley wonderful. People make mistakes. If he was a constant criminal, it would be different, but this was totally out of his character.

Yes, it is a legitimate charge. I have arrested and charged folks under the same type of circumstances. Any use of force or threat of force to commit theft or flee from a theft is robbery. Use of a deadly weapon or infliction of serious bodily injury is an aggravated robbery. Most probably, the D.A. will offer a plea on a reduced charge of simple robbery or, if he's lucky, offer a plea on theft and then a plea on assault. He needs a lawyer, without a doubt.

In most states once you conceal an item you can be charged with shoplifting whether you leave the store with it or not. Also, if you shoplift and then use violence in order to get away, you can be charged with robbery. If the violence you use involves a weapon or serious injury it bumps it up to aggravated robbery. It was stupid for the Manager to try to extract your boyfriend from the vehicle ,but he technically has the right. In most places a person representing the store can use reasonable means and force to detain a shoplifter for the Police. It is more or less a citizen's arrest. Your boyfriend better find a good lawyer and start apologizing and praying.

Well, I'm not a lawyer, but I did watch Judge Judy last night.

Judge Judy's favorite statement is, "If it doesn't make sense, it probably didn't happen."

Do you expect anybody to believe that your boyfriend ditched the cologne before he left the store?

My bet is that he chucked it after he ran over the store manager. Nobody would be stupid enough to keep the cologne after he knew that a store employee had observed him stealing it.

So, your boyfriend is guilty as sin.

However, you can beat the rap. Just use some of your disposable income to hire the best defense attorney you can afford.

Remember that justice is a pendulum that swings toward the client with the deepest pockets.

If you just rely on the prosecutor to drop the case, you're likely to be visiting him in the local jail.

I hope so! If the manager or a security camera seen your boyfriend put it in his pocket then yes it will stick. If nothing seen him do it then no. About the car and the foot, your boyfriend will probably be charged. He was still in control of the vehicle when this happened. Nothing was stopping him from hitting the breaks. He was scared of getting caught, panicked and tryed to flee.

No, but he needs a really good attorney to get it pled down to a first timer level offense. STUPID store manager, who the hell chases down a moving car over a bottle of cologne.

Why are people so willing to put themselves in harms way over such puny crap? Write down the plate number and move on.

He is guilty of a crime i would say aggravated robbery. He is probably more guilty of 1.Theft By Shoplifting, and one of the following either 1.Aggravated assault, or 3. Leaving the scene of an accident. His actions put everything into play and if they have the camera or eye witnesses then he may be convicted.

First of all Chloe. . .your boyfriend is a dirtbag scumbucket doooooochebag! Nice choice there. . . you must be a real piece of work yourself! Anyhow.. . . . I think the charges will stick. . .and I hope they do! If I was on a Jury. . . I would reason . . your scumbucket boyfriend put the cologne in his clothing. . . he showed intent to steal. . . . he also could have stopped the car. . . . If you spend a ton of money on a lawyer I'm sure you can get the charges lessened or dropped. . . however. . . I hope he gets all the charges as scumbucket guys like your loser boyfriend need to be stepped on and squashed!

Poor boyfriend!!! Golly I feel sorry for him. That rotten store manager following him like that, expecting boyfriend not to petrified. Gee...lets just forget the whole thing ever happened. In fact lets charge the store manager with assault an petrification on boyfriend. Your boyfriend is an idiot and so are you!

Hope the bottle of cologne was worth it. He was brave enough to steal, but then had a panic attack and hurt someone. I would hope they put the max penalty on him. Shoplifting cost us honest people 1000s of dollars extra in purchases.

Store manager had no reason to grab him.
If anything he should have taken his plate number.
The only one I can see breaking the law would be the store manager, you can't obstruct someone who's behind the wheel like that.
