The term "anchor baby" does not have a fixed legal meaning.
But under Section 1 of the 14th Amendment, everyone born in the US is a US citizen.
"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside."

I hope you know the answer is that any child born in the US even among illegal immigrants or even foreigners who happen to just be visiting would be given American citizenship and have all the rights and liberties that includes. I also believe the same principle applies in most other nations as well- especially the more modernized ones; I was nearly born in Australia myself and would automatically have been given dual citizenship. My niece was born in Germany (one American parent and one German parent) and enjoys dual citizenship. As another responder has stated, just because they have a child born in the United States, that doesn't mean the parents have any claim towards American citizenship. Traditionally, many illegal immigrants have come to America to deliver their "anchor babies" both with the knowledge the child then gets American citizenship and with the hopes they will be put "on the fast track" and/or awarded American citizenship as well- which often happens due to Americans overly compassionate behaviors. This "anchor baby" ploy is not new and I can remember hearing similar stories to this recent case for decades. Again, usually the mother has been allowed to remain, given channels towards citizenship, etc.- but not always. Sometimes, the mother/family will be deported and the child, despite having American citizenship, then returns with the mother/family to be raised until deciding at a later point whether to come back to the US. Other times, I think the child may be left to be raised by family members who are citizens or legally inside the US; I'm assuming another option would be for the mother/family to simply leave the children as wards of the US to be raised here through orphanages/foster care knowing that the child will still have more opportunity than they would back in the country their parents come from.

You'll have to ask the Supreme Court, they specifically reserved that issue to decide later when they extended certain of the Constitution's protections to legal residents under the 'jurisdiction of our laws' clause.
You do realize that children of diplomats born here are not US citizens, because they are still too much under the jurisdiction of their home country? The question is where do illegal immigrants' children fall in the spectrum.
Our programs treat them as such, however.
I think what we need to do is stop chain immigration. It is the parents being able to leverage their own situation on their child's birth, once the child is of age that makes people so mad. The child can't help it, but the parent knows what she is doing, and is taking advantage of US taxpayers.

no, the only the reason the mother came here,was to have her baby for free and live off welfare.they should take these women back over the border,before these babies are born.dont matter if its heads showing.
