No it's not illegal. It's illegal to fund it from the USA.

As for casino games, the future status is uncertain, however there was a federal court ruling (often referred to as the "Mastercard Ruling") where the court said that these online casino games were not illegal by the wire act because there is no way that this law could have been intended for playing casino games over the internet. Currently it is not illegal. Most casinos, however, will not be able to accept visa and MC from USA. The banks have blocked them. There are several other deposit options you can use at an online casino.

there are casino cruises out of florida and they don't open the casinos until they're 30 miles off the coast. at 30 miles, it's considdered international waters and the gaming comission has no real legal jurisdiction there.
