Is sending you back and forth and neither will give you a straight answer. This is about an erroneaus item on my credit report, that the beaureus refuse to take off. I am so upset over this. These people have been messing up my credit since 2002. I'm begining to think I should just pay for it, even if the charge is not mine just to get over it.

I just saw this message as I was leaving for work, so I don't have time to completely respond.

Nutshell answer.....the creditor/collection agent MUST validate this debt (prove it's yours). Read the Fair Credit Reporting Act.

If it's not removed, you can file a small claims suit against them for $1000, plus any damage this listing may have caused you. It's very simple to do, and you don't need a lawyer.

I filed a case last year and won $1200 form a collection agency that wanted to be a jerk, just like yours.

You are entitled to a copy of the charges that claimed against you from the creditor. You can also submit a letter to the credit bureaus stating that you dispute the claim being made by the creditor. Once you have exhausted all means, you should contact an attorney.

It's something that won't be corrected overnight.....Good Luck!

Everything should be in writing. Absolutely do not pay it off just to get rid of it! That will mess you up worse than you are now. It will show you own the debt and you will have to wait 5-7 years for it to clear up. Put your protest in writing, and submit it to the 3 main bureaus. They have 30 days to either protest or not and after the 30 days if they don't reply, it gets removed.

Good luck, this happened to my sister, she was charged for a hospital visit and she wasn't even living in the same state at the time, but it finally got cleared up.

Deal with the source, the creditor not the agency. The agency only gets money if you pay...they are not interested in the truth. Cornell Law School has set up a great page for consumer credit law and advice....Check it out.

either pay for it or obtain legal aid, those end up being the only 2 choices
