The issue of software patents is a subject of intense debate as of even now, I guess. What I don't understand is the whole idea behind it. I just think the whole justification for patenting is questioned. However, I would want to know the pros and cons of software patenting.

Okay in my opinion patents are restrictive. And I'm taling about with the idea of "free software" (as propounded by R. Stallman - www.gnu.org) in mind. Somehow this concept has opened my eyes towards freedom - what we lack through the nature of our intellectual property systems.

Ain't it so that if some ideas were free wouldn't there be more development with respect to that idea...?

Now a days softwares are becoming open source; Providing a patent may have some effects like prevention of sharing of resources.(as well as knowledge).so softwares should not be provided with a patent..

Well I am a student of commerce and I guarantee you that patent is the thing which most smart people do.

Patent means registering the idea, product and the design, etc with a govt. statutory body, so that when you need to sell that idea, product or design to any company, you get paid to that extent.

If you do not register, than anyone may steal you idea, design or product and claim that it was his. Thus, he will sell it to a company and earn money or royalty. Thus, you will lose your money.

But if you have 'Patented' you product, idea or design; and if someone steals it, than you can claim it in the court of law. It will work like a protection.

Now, in case of software, it is easy to hack into a PC and even easier to steal it. you have to copy-paste the code.

ADVICE: GET THE SOFTWARE PATENTED AS FAST AS POSSIBLE TO ELIMINATE THE MISUSE OF IT.

PL: DO NOT STEAL A SOFTWARE OR HACK IT, IT MIGHT AS WELL BE PATENTED

Only Revathi Priyadharsini's answer is correct. The others do not seem to understand software, and how different it is from a newly invented machine.
There is a petition going on to continue to keep the EU free from software patents, considering their damaging effect on innovation and competition.

well the pro's are that its your idea and if anyone else uses it you can sue them....

however you cannot get rid of piracy so in a way it doesn't make a diff if you patent it...
