No, your dad shouldn't win, because it was his fault. The car in front of him didn't run into your dad. Your dad ran into the other car. He shouldn't have been driving so close to the car in front of him and he should have known better. Why in the world would he even bother trying to sue the person driving in front of him? That is just stupid. Your dad should spend the money enrolling into a driving school instead.

ok, if the car in front of him stopped, then how could he run into your dads car?t is common knowledge(with the exception of the guilty party) that the one who rearends the car, is the one at fault for several reasons, following to closely, failure to keep the vehicle under control....in some places....wreckless driving.
if i had been the one your dad hit, my door would have flung open so fast and my *** hit the road holding my neck and screaming i was in so much pain and cant feel my legs, etc, got the best injury attorney, and i would sue for everything that the law would allow.
if i was your dad, i would forget all about sueing the person that he hit, and be praying that the person doesnt sue your dad.

If your father crashed into the back of the other car, it's his own fault, because he obviously didn't keep the safe distance between cars then. He should be able to stop on time even if the car in front of him stops suddenly. I think he'd lose that lawsuit. Usually it's the car that crashes into the back of another car that has to pay all the damages. He can expect a lawsuit from the other driver.
I've had a crash like that myself. Someone crashed into the back of my car when I stopped at a red light and he had to pay for all the damages.

It was your father's responsibility to be following at an appropriate distance to stop. He should have seen the light change and know that the person in front of him was going to stop, and appropriately adjusted his speed. He is very much in the wrong, and were I in the other car, I would have sued your father. He was at fault for the accident, just as the officer cited him as so.

Although it sounds like your dad could win, the other side will probably argue that if your dad was driving responsibly, he would have had sufficient time to stop his vehicle before the collision. Also if he is dropping a drink make sure it doesnt sound like he had it in his hand at the time cause obviously that would limit his ability to react. How could he have run into your dad if he was in front? If you hit someone from the rear you are automatically at fault. If your dad has insurance there will be no need to sue. Insurance pays.

The only chance that he has is if he can bring forward witnesses to corroborate his story. It is always assumed that if you rear end someone that you were following too close.

whatever happened, or whoever is right or wrong, one thing can make ur dad win.. get a good lawyer. a good lawyer, who have won cases similar to ur dad's and the like.... bec a good lawyer can do all the twisting in court and make the case in favor to ur dad
