Actually, 1st degree murder has the most severe penalty. It is usually premeditated or extremely brutal. 2nd degree murder is not premeditated but may occur out of anger or a similar situation. 1st degree is the only one that can carry the death penalty.

1st degree murder is premeditated here in the state of Michigan is a mandatory life sentence. 2nd degree murder is like when you get or *** kicked and you pull a gun and shoot some one. The sentence is 20 years to life.
