Some states are not mandatory insurance states, so he would not be required by law to show you his insurance card. If you have his tag number, it's possible to check into whether a tag trace can be run to find his insurance (if the state records that- some don't).The police may be able to help with that. Yes, you can have him served with suit papers, but even if you do that yourself, it will cost you something to file even in small claims. If you have insurance, even if you don't want to have them handle the claim, they may be able to run the tag or try to reach him to find out if he'll reveal his insurance to them. They may get better results.

Contact the police, file a report they will run his tag # and be able to get his information.

I know because:
I aprked in a parking lot at a national park, when about my day with my wife. Came back to my car, there was a note signed from the park police saying that some guy who had been parked near me came back to his car said I hit him and told the park rangers. I called the rangers over and in a Reno 911 type move they said they saw paint from his car on my car but I couldn't see any. They said they had already run my plates gotten my insurance info and given it to the guy. According to my insurance company he never tried to file a complaint.

You should call the police to take a report on the scene. The other person, by law, has to show you his/her ID and insurance.

He is not required to show you his policy information. Police report will show name of his insurance company. This should be all you need as you should always file a claim through your company and let them handle this.
PS -- don't bother with a lawyer -- your company has an army of them.

Don't sweat it! Let me explain.

His liability insurance policy begins with the words "We will pay all claims for which you become legally liable . . ."

You don't need his insurance . . . he does!

All you have to do is file a lawsuit and have him served.

He will run to his insurance company quicker than Richard Petty on race day, and they'll be on it like ugly on ape in no time.

Report it to the cops.

And if you can weasel the name of the insurance company out of him, you can just call them. Did you get his license plate number? Did you call the police when the accident happened?
