I've been real worried lately bout driving under the influence, I know, duh, I should be. Other than saying I shouldn't do it, which I know, what should I do if I get pulled over? Blow in the breathalizer or not, do I tell the cop I drank or not? Real advice only please. There's some times when I don't really have a choice and I gotta drive home

I understand your position. Everbybody has gone out with friends after work and just wanted to get home. I have been in positions where I was going to need my car first thing in the morning and couldn't afford to leave it. First and foremost use other options if you have them. Try to eat before you leave the location. Be very careful, keep your lights on dim, bright lights are a dead give-away. Drive as you normally would don't drive slower or faster. Make sure you stay between the lines. If you use a breath fresherner, stay away from the mint, use cinnamon or something of that nature bubble gum or lemon juice. Eye drops maximum strength Allergy Cold Relief, gets the red out. Make sure you have on colonge. Know where your drivers license and insurance is so you don't have to look for it, if you get pulled over. When you get pulled over don't throw a wad of gum into your mouth a dead give-away. Don't try to light up a cirgarette when he approaches of after he has your license, bad move. Answer the officers questions politely. If he corners you on the drinking question, say something like after work I had a beer with dinner. But that was like 6 hours ago. If you get an *** you are through. You have a right to refuse a roadside test you don't have to blow in the roadside box, but it will make things worst. Once you are under arrest and read implied consent you cannot refuse the test on the machine at the station, or the sobriety check points if they have a mobile intox machine. If you refuse the real test after you are arrested then your previlleges to drive will be suspended. So in most states its not illegal to drink and drive. Its against the law to be in excess .08 grams, or .04 if you have an accident or commit a less safe act. If you are arrested just go through the motion don't say anything and don't curse the cops out. You will need an attorney to try and save your license.

You always have a choice. You either drink and drive or you don't. Before you start drinking, knowing you are the only ride home you have, maybe you could sit there and picture a body coming through your windshield, landing on the seat next to you, bloodied and dead. Then imagine yourself sitting in a court room, being judged by 12 of your peers who have no tolerance for people who drink and drive. While your sipping your beer envisioning these things, take a good look at the faces of the victims family who will be sitting in the courtroom listening to how stupid you were. If that doesn't cause you to make a choice not to drink and drive, imagine your fate in the hands of those 12 people who did not choose to sit there, losing a day at work, paying hard earned money to appear and listen to how stupid you were.

That should answer your question.

Yes, you do have a choice, you can call a cab, or better yet, don't drink. If it has come to the point where you HAVE to drink, then something is very wrong. You can tell the police whatever you want, but they will know. If they are under suspicion that you are under the influence and you refuse the breathalizer, they can automatically suspend your license. At least here they can for 1 year. Also, they will make things very difficult for you when you refuse and they know you have been drinkng.

You'll get in trouble even if you don't agree to a breathalizer test. At least in New York State. Just drive slowly and don't swerve around the road. Just try not to look suspicious... they're not going to just pull over random people. But as always if you've been drinking alot please DON'T DRINK AND DRIVE. And wait at least an hour since your last drink before getting on the road.

I used to Drink and Drive a lot, thought I was a better driver than most. A DUI and $2000 later, I have learned about the harsh penalties. If you are like me, you don't care about the infinitesimal chance of killing an innocent bystander, but you will care about the court fines and the time lost.

I always walk or get a ride to party now.

If you do get pulled over, just admit it and do what the officer says. Anything else will just get you in more trouble.
Most states have an implied consent law - meaning that just by driving you give consent to give an officer a breathalizer test. If you refuse, you are charged with a DUI anyway.

Try your best to find a D.D. or just not to drink too much. It's much safer. Otherwise, if you do get pulled over you HAVE to blow into the breathalizer or else they can take you right in for refusing.. they will know you've drank. Be honest to them, say you have or else you will be lying and can get arrested for that. Just be cooperative with them and maybe the will go easy on you.

.... you do have a choice, but you choose the wrong one!! It is people who make the same choice as you who kill innocent people.

I hear a lot of people say, I only do it on the way home from the bar....... there is nobody really out that late, but that is lame!!

I had to take my son to emergency at 2:00 in the morning because he woke up screaming with an ear infection. What if some drunk had hit us??

THERE IS NO EXCUSE!!!!

Your first choice is not to drink, if you are in a mind set that you will eventually be too drunk to drive then I suggest you nip this problem in the bud before you get any older. The second choice is to call a cab or a friend to pick you up, I personally do not care if you get busted, in fact I hope you do before your stupidity kills somebody.

There are always choices: 1. Don't drink when you have to drive, 2. Call a cab, 3. Call a friend.
