If the individaul moved out and you have been storing their items, which are located in the residence once shared? After a month they return and want to collect their items but since the time that they have left the remaining party incurred multiple debts that were to have been covered by the returning party.

Not sure about in your world, but here on Earth that would be called theft. Any owed rent is a civil matter. Your actions would be criminal ion nature and you can and should be arrested for your actions.

Ok.. need more info... are you the land lord or the ex room mate? 2 of you shared rent?? you have been storing their items on promise that they are returning for their belongings?
if you are just a ex roommate... and holding items for collateral and dening to let them get their belongings... is wrong. you can be in trouble.
if you are just a ex roomate... and they never returned for items then 6 months they are rightfully yours to keep.. (at least where i am from) possesion is 9 tenths of the law.. of course after the statue of limitations is up... (6 months)

i think that's stealing. the individual can come by with a police officer and demand return of their items. if you admit to the police office that those items are not yours, he will ask you to release them. If you lie and say those items are yours, the police officer will ask the individual to describe the items, he will then ask permission to come into your home and have a look. (personally, any person that leaves their items for more than a day after leaving deserves to lose those items, but that's only my opinion)
As for personal experience, i had to do something similar to a friend. I was going to stay a whole other month with her. Rent was due on the 4th, i came to pick up my stuff on the same day. I decided not to stay due to the fact she tried to slit her boyfriend's throat that week in front of me and her 1 year old son and i didn't want any of that drama. Then her stupid boyfriend got drunk and decided to hit on me. I had someplace to stay, so i left! I called the police when she tried to tell me i couldn't have my stuff back. They showed up and helped me move my stuff out.

I think they have thirty days to come get their stuff otherwise it's yours to throw away. If they owe you money then they need to pay that or sell their stuff to cover the costs. I would check with a lawyer though because you don't want to end up in court. Good Luck.

Yes - you have to have a court order or judgment in order to put withhold belongings. You can be charged with theft.

Check your municipalities Landlord Tennant Laws- This may be legal where you live- or not!
