It been confusing.
My baby father isnt working a lot right now.
Layoffs.
So now hes going to school full time.
He plans on completing a degree in a year or two.
He lives in Michigan I live in Texas.
How would I work out child support?
How much will i recieve from him?
Do I have to file a claim to try and get child support?
Ive heard its based on the fathers income.
Now what if he operates a small business on the side?
We only have one child together and a lot of people are saying I will get pretty much half of everything he makes.
Is that true?
Any help is greatly appreciated.

It is difficult to answer your question, only because states differ so much. I would recommend starting at the Michigan Department of Human Services: Office of Child Support: http://www.michigan.gov/dhs/0,1607,7-124-5453_5528---,00.html. You can also check out the State of Texas Attorney General: Child Support Services: http://www.oag.state.tx.us/child/. I am not sure which state would enforce the support. They will typically take into consideration both of your incomes. I wish you luck.

Regardless of what state he is living in, he will be required to pay you support....even if he is no longer working. Child support can be figured out based on what the court figures he is capable of earning. They may take into account that he is in school and trying to earn a degree so be prepared for that. He will probably look for sympathy....

You will have to get a lawyer and file a petition with the court (I would think it would be in your jurisdiction but I am not certain) and you will both have to fill out financial statements showing what you earn and what your living expenses are.

Depending on what state you live in, you will get a certain percentage of either his net income or his gross income....if he is not working they will set an amount that they consider fair to both you and him....it is at the judge's discretion and you may not necessarily be happy with the outcome. Make sure you ask for health insurance once he is working if you do not have any for your child and you can also ask for half of unpaid medical expenses (at least where I live)....These are all things you can ask your lawyer....

You will not get half of everything he makes...don't believe everything you hear. You will get a percentage but he has to be able to support himself as well.

I find it interesting that he is all of a sudden going back to school. If he has a small business on the side, you will need the information on that so you can base the child support on that income. How much you get will depend on a few things; the laws in the state, how much you can find out about his income and if you have a good attorney.

How much you get depends on which state you live in. Here, in NH, they can take up to 50% of the net income.

here in indiana they dont care how much u work or dont work 50 a week and if u dont pay u go to jail

It all depends on what state you live in................. Don't count your chickens before they hatch !
