On December 09th,2005,21 yer old Thomas Roy Kennedy,shortly be fore midnight,was askd to leave an all Nude club called The Fantasy Five Club.Apparently,he follow ed the bouncer advice and left.In the meantime our 12 y.o. son CJ,and four oyher kids,the oldest being 17 y.o.,ran out of gas at the Monroe/Bellfort exits on southbound I-45.The kidswere out of money and couldn' get anyone to give enough to get home.Daniel Graves who was driving the car the kids were in,called his father and informed Hin of the situation.By this time is was shortly after midnight on the 10th.The police estimated the kids waited for about 17 miniutes for Mr,Graves to get to that location,Obviously,it only took Tommy-Boy aboout 15 minutes at which tjme he ran into the rear of Danilel's car and killed 2 young girls and left my son with a severe head injury.

OH my goodness! I don't have any answers for you, but I want you to know I will be praying. Is there anyway you can sue the insurance company? or did the drunk have any insurance?

I lost my 18 old niece to a drunk driver. She had her life taken because of some drunk! I am a M. A. D. D I think they should not allow drinking anymore. If people are going to drink they should stay home and do that if someone wants to destroy their own life, but why others? It should be against the law to have bars.
It is just so wrong and I wish people would speak up about drinking in public and driving. Make them walk for the rest of their life. They should never be allowed to drive if they are going to get behind the wheel after drinking.
OR Mark it on their drivers license and make it the law not to serve anyone who has been caught drinking and driving. Show your ID before buying any liquor.

You can sue the driver of the striking vehicle, and you may also recover from the liability coverage on the car in which your son was riding. There was negligence involved in both driving drunk, and in running out of gas.

The club did not tell him to drive, they told him to leave. They should have no liability in this case, but some money hungry folks will try to make them pay anyway!

Tragic accident. The driver/owner of the car is responsible for the medical bills for your son. The police report should include the name of the driver/owner's insurance company. Get a copy of the police report and then contact the insurance company and find out how to have the medical bills and any other therapy bills paid.

hopefully you attended the hearing for the DUI case on Graves. In which you should have requested restitution. Also apply for the county restitution fund which is in addition to whatever the court gants the idiot pay out damages caused by his recklessness. Then you can file a civil suit and sue that hell out of that idiot and garnish his wages. Then, try and file for medi-cal in your state, It is possible to collect disability on his behalf if his injuries are lifelong.

contact a personal injury lawyer ASAP! Time may be running out...if you wait too long, the statutes of limitations law takes effect and you won't be able to do squat! That varies from state to state, so call one first thing in the morning!

You need to get a court appointed lawyer. Has the case gone to trial and have damages been awarded? Should you be talking about the case at all?

Contact your local Mothers against drunk driving..they can help you pursue and give you advice..

also contact a lawyer with your story...usually they have free consultations
