Your case unfortunately doesn't require an attourney... I say unfortunately because unless the price for both dogs was more than $5,000 your only option is small claims court.

This country has a perverted sense of personal property... your dog, your best friend, your companion is only considered a piece of property under the law... she is treated like a car or a kitchen sink... not like the family member that she is... the only damages you can collect are the financial cost of the animal and any expenses like vet bills... there's no compensation for pain and suffering of you or the animal... it's a twisted law but it is what it is...

If you had a contract with the breeder you may have a case. But it is a buyer beware world out there and many times people get basically screwed out of there money. The breeder can say the puppy was healthy when it left and can say it must have contracted something from the ground or other dogs you may have. It is very important that you take any puppies or adult dogs you purchase directly to the vet once you get them home. It only takes 3 days for a dog to become infected with parvo. So if your puppies have that. And were not looked at right away. There is not much you can do. Especially if you have already said there were NO Symptoms. Most attorneys with say buyer beware.

Some of this, if they were sick with a virus, will depend on how long after you got them that they became sick. If the breeder or store you bought them from doesn't give you a written guarantee, then whether you have a lawyer or not, you will probably be straight out of luck. If you had them shipped to you from another state, you would need a lawyer who is licensed to practise in the state the pups were shipped from. It's a hard learned lesson, but if the breeder will not help you out by returning your money or replacing the pups down the road, (if it was parvo or viral, do NOT bring another puppy onto the property for at least a year, vaccinations on puppies do not protect them well from parvo!)then you will be out of luck. If they were not showing signs of illness when you got them, then the breeder will also not know whether the pups got it at her place or at your place unless she has other pups sick out of the same litter as your pups. If it was viral, and no other pups got sick in that litter, than you could easily have picked it up after her property. Vaccinations do not work if the pup is still carrying immunity from the mother, so if you vaccinate your puppy and two weeks later, the mother's immunity wears off, then for the next two weeks until your next vaccination is due, your puppy is unprotected. That is why a series of vaccinations is given, hoping to catch your pup with the shot's protection almost immediately after mom's immunity wears off. Talk reasonably with your breeder, and they might feel sorry for you, even if it was your place the dog got sick, and give you some of your money back. If you want another dog right away, you'll need to get a fully vaccinated adult if your pups died of a virus. A good idea would be to write back in to this site and tell us what the pups died of.
