I brought my vehicle 2 a mechanic 4 an oil change and brake job he takes it out on a test drive and gets in2 an accident. The other car involved in the accident takes full responsibility 4 his actions his insurance has provided me with a rental and will be covering any other issues. However i still have this bad taste in my mouth because I have been inconvenienced now I have 2 go out and look 4 another car. (my car they totaled was new I only had it 4 2weeks) Do u think a lawyer will be able 2 help me recover more funds for my 'pain and suffering,' or should I just take my check 4 whatever the car is worth and smile?

I would def. consult a lawyer, if for no other reason than to make sure that you are not being shorted anything by this other person's insurance or the car dealer who wrecked your car. It never hurts to get a second opinion. I however, am personally against suing after a car accident simply to get more money (that's called greed, and it'll come back to bite you in the *** someday). If you were in need, or really suffering, that would be different. But since I think a few afternoons of looking for a car isn't really "pain and suffering", I would not (personally) go after an innocent person just to make a few bucks. I mean, after all, it was an accident and these things happen, and you should be thankful that no one was really seriously injured.

It couldn't have been brand new, if you took it in for a brake job after having it for only 2 weeks. "Pain and suffering" is not a factor. Inconvenience is a factor. You should insist on getting at least the RETAIL value of the car, not the wholesale, or trade-in value. If it's a $50,000 BMW, then get a lawyer. You could talk to a lawyer, and ask what he would charge for his services. Either way, let the insurance Co. come to you and make the first offer. You can turn it down and wait for a second offer from them.

Most people I know have been involved in an accident and had to look for a car. Not exactly "pain & suffering"

for one ting if you were to see a lawyer on this plus attourney fees etc, and court costs, and i assume you are still working right?? you will have too take time of rom work if you decidedd too drag this thing threw the court systems, and for what pain and sufering did you realy go threw here you werent involved in any accident(maybe you had something on that paun and suffering thing but i doubt if it woould hold up in court here) take the check for what ever the veichle in question is worth and baill okay, first, then go threw if you wish and then start the process of suing for pain and suffering if this what you want-- first get your money out of itt etc then sue only if you want to but i dont really think your gona gain much here okay etc, so just baill!

What i think of is that your chum's spouse is crying out, desirous to be enjoyed and understood via her husband. She feels unloved, and because no longer the rest has carried out the trick, she is consulting divorce legal specialists, hoping he will finally understand how plenty she desires him. i think of there are very sturdy opportunities of this marriage surviving, as quickly as the two one in each and every of them take a seat and communicate approximately their desires at the same time. terrific desires on your chum.

if you were in the car with the mechanic then there's "pain and suffering". but if you were not, then there isn't.
