Yes. And more than that, a violation of existing federal law.
Read 50 U.S.C. §1801 et al. (FISA) Warrantless wiretapping is illegal if anyone US citizen or resident alien is a party to the conversation. Read 18 U.S.C. § 2511: Compliance with FISA "shall be the exclusive means by which electronic surveillance... may be conducted".
The sad thing is, the administration could have done all of the same things and conducted all of the same surveillance within the laws, just by following the proper due process.
Bush just chose to ignore the laws, because he didn't think the executive branch should be limited by Congress or the courts.
I'm not so sure the Supreme Court will side with Bush on this one, though. They've slapped him down several times for violating federal laws and overstepping constitutional protections.
And here, he did it because (in his own words) he didn't think the court should have any authority to review executive actions. And the Supreme Court cannot let that sort of attitude slide.
The precedent it would set, that the executive can willfully violate federal laws any time he wants without judicial oversight, would destroy the checks and balances that our entire constitutional system depends upon to function.

Who needs the Constitution? I mean, it's only a piece of paper with outdated ideals that have rung as true today as they did so long ago. I mean, who cares that men and women have bled and died for the ideals set forth? Who cares that it is the single greatest document ever written by man? Who cares that it is the source of all that makes America great? Really, it's just the difference between us and any other third world dictatorship. Who cares if we toss it out the window? I mean, The Bill of Rights? What's that all about? All men created equal? We all know that's not true. You have to be a rich, white heterosexual male for that to apply to you. And what's this crap about the rule of law? Where did that enter the picture? Who was the genius who thought that up? Really. Come on now.

Now relax. The conflict on Terror does no longer hinge on those wiretaps. the authorities can take the more effective jiffy to bypass to the secret FISA court and get a warrant to any extent further. 2d, we are actually no longer on our thanks to dictatorship. that's only a classic "verify and stability" occurring in our authorities. the government (Bush) is attempting to amplify his power and so on. And Congress and the Courts are reeling him in. constructive, I see your factors. constructive, I understand no one needs to resign any liberty. constructive, authoritarian governments are undesirable. yet I do have self assurance you're thoroughly overreacting and exaggerating. that's merely standard politics and authorities governing. a sparkling application grow to be tried out and it form of feels to conflict with the Consitution. properly, wager what? The Constution wins because it continually does. Freedom wins. Democracy wins. some might want to assert finally it is going to lose. inspite of the undeniable fact that the authorities will say this methodology is "mandatory," even as they are going to do merely fantastic without it. it is all politics besides. If the terrorists strike the following day, the Republicans will use this to assert seem the liberals are literally not preserving us threat-free!! it is merely partisan politics to save Republicans in place of work. you're appearing like something terrible is occurring right here and we are on the line to Fascism. relax. suited desires on your street to relax and a a lot-mandatory project-loose vacation.

We need to hope that Americans wake up and see the errors of this administration. Vote for better candidates from now on. Bush and his administration are creating a mess. The congress just blindly follow Bush - WE NEED CHANGE, NOW!!!

This program has been going on for decades, so I believe the supreme court will uphold it. The ACLU in Detroit (home to a gazillion Muslims) have yet again shown their preference to terrorist and criminals.

I am afraid you don't know much "Dude" the Supreme Court has a higher liberal side than Conservative. I do find it interesting that the judge who ruled is a left hard liner.
