This is for those who argue that if the child is born in America, the parent shouldn't be deported because it is punishing the child for their parent's mistakes: Does that mean that every immigrant can just come across the border, get pregnant, have her baby, and then she is just automatically a citizen because we don't want her to leave without her child?

That is the exact problem.

A child should only be an automatic citizen if their parent is in the country LEGALLY at the time of the birth. Otherwise, ship them right back and send a bill to Mexico for the cost of her hospital stay.

No! Illegals do not fall under the "subject of jurisdiction thereof" of the 14th Ammendment. Neither do those here on work or tourist visa's, etc..

The government has just not been doing it's job by going into each case and verifying the parent's/ child's uneligibility.

Law experts are currently working on this to set the phrase straight! All those here illegally-- deemed citizens will be forced to pay back their allowances and they will be deported.

Will this actually fly is the question? I wouldn't be surprised if it didn't. But, at least somebody is on top of it- trying to uphold the U.S. Constitution.

This is why the Constitution needs to be changed. In Europe and most other countries of the world you aren´t considered a citizen just because you happened to be born there. At least one of you parents should have to be an American citizen. If not, too bad, sorry your kid has no right to be a citizen.

Where have you been? That is what has been going on along the border towns for years. In El Paso.. EVEN TODAY.. there are ambulances on the American side of the bridges WAITING for a pregnant Mexican woman to come close to the American side from Mexico.. have her water break (intentionally) and then the American border people are OBLIGED to have her taken to the American hospital to have her baby.. the baby is then an American citizen.. It is ABSOLUTELY NOT RIGHT but that has been going on for years and still is.

I think that the CHILD should be allowed to stay, but NOT the parents. Some people argue the child should be deported, but that is just wrong. They were born here, done nothing wrong, and are totally legal.

she isnt a citizen so dont make a fuse about it cry baby there is no law that states that ok. only the child is the citizen

If you are talking about Elvira whatsherface, I would like to suggest that they let her leave voluntarilly, then she can get her papers and come back, Hopefully she has saved enough money. If they deport her, she will have to wait 10 years before she can bring her American child back to the US, or he may be waiting for her in foster care here, paid by our taxes until then. It all depends on if she has anyone that can take her child to Mexico for her, since she will be in handcuffs and a orange jumpsuit behind glass.
