My best friend's fiance recently just got her Green Card and he's illegal. They've known and live together for more than 5 years. If they get married now - what are the chances of him being deported?

I am not quite sure dear.. but with the research I have done for my BF moving from Canada down to the USA (he's Native so does not require a Green Card), my understanding is this:

1) A Green Card makes you a legal alien, not a citizen, which would mean that if she married her illegal partner, she woud/could be deported (and more than likely would) and so would he.

2) Because the marriage was not between a US Citizen and a Non-US Citizen, the Non-US Citizen would not automatically become a citizen by marriage because the 'legal one' only had a green card which states they are a legal 'alien' which means they are allowed to live and work in the USA but are not legal Citizens.

Again, this is just a pure educated guesss based on the recent reading I have done, I hope someone else can help you better than I, and if not, I did my best. BEST WISHES!!! Welcome to the USA LEGALLY and umm no offense but ask the BF to go home until he gets his Green Card too (and/or can marry to become a legal US Citizen :)

He has no status married or not to a green card holder. One has to be a US citizen and than he would still be illegal. Tell him to go home.

Given the amount of xenophobic hysteria which dominates the fascist-like state of the American public and their respective government, I would say the chances are close to 100%.

The chances aren't that high, then again, there are lots of immigrants out there, as long as they aren't saying anything that could incriminate them....nothing will happen :) it's just a matter of how the go about it.
