i was out of town for a few days that my mom was in the hospital we didnt know it was so serious so the niece held the dog till i came back then she didnt want to release it and i was busy with my mom day and night.

You really need to get a lawyer or you could simply whip her butt and take the dog. Break in her house and take it. If there's any chance that she lets the dog out without supervision then snatch the dog up and take off.
I know that fighting isn't for everyone, but if it were my dog I'd beat the daylights out of her. Of course, I do enjoy a good fist fight from time to time.

tell her the dog has a serious medical condion and you need it back to give its meds or it will die , or tell her it have to get a 300 dollar a months shot every month from the vet to keep it alive i bet should give it back real fast

in that case i would get in touch with the police find all your paperwork out for this dog vets bills etc and take it to the police and report her for stealing the dog
