It would be easier just to get a new dog. You can take it to court but the problem is the argument of "if you wanted the dog, you would have taken care of the dog for your mother instead of your niece". Your niece so an opportunity and jumped on it unfortunately.
Dogs are considered property. If your mother left a will behind, see if the dog was included. If not, and if the dog means THAT MUCH TO YOU take the matter to court and let a judge decide.
If the dog is just reinstates feelings of sentimentality, then let it go and get a new lil doggy to call your own, knowing that your niece can't touch it.

If the dog was left to you from your mother's estate, I am assuming she had a will. If not ,your only recourse is to contact a lawyer.Don't get one who advertises on TV, get one who specializes in wills and estates. From what little I know about the law, the dog was your mother's, and since you are the next of kin, the dog is now yours. Good luck, and I'm very sorry for your loss.

Just let it be..that dog is used to her surroundings now.
Think of it as her way of dealing with pain at the loss of your mom.Consider that act of your mom as a gesture of kindness,a remembrance from her grandma so to speak.
Reading your notes I take it that your niece is taking it with the best care she can possibly give so be happy.
Of course,it's an issue if that dog is maltreated but I don't read any of that so just let her keep that.

for the sake of your niece..
for the sake of the dog.

There was a very good reason your mom left the dog to her. If I were you I'd get another. There isn't anything you can do about it....your mom obviously new your niece was the best person for it......life is to short..go on with yours.

If this problem doesn't resolve, I guess you may have to involve the police. That is if you can proove the dog was your mother's and that she lived with you. Do you by chance have any vet receipts, etc. If the dog is papered, then that will help. I believe you should be able to get the dog back if you have all of this to back you up.

If she loves and cares for the dog then let it be.
If she has just taken the dog out of spite seek a legal outcome!!
Your mum must have thought that your niece would care for the dog when she let her mind it??
Never fight after a loved one has passed away just think deeply (in your heart) what would your mum have wanted you to do.

since you long for the dog, you must have it back before you go crazy.. Just kidding. But true, you have to get the dog back especially that you had a great trio bonding (you, your mom, and the dog).. It's all that you have and the only one thing that connects you to your mother. Just make sure that dog is still familiar with you...

i think your mom knew what she wanted when she gave the dog to her. your looking at it as a pedigree that dog is a living soul it should go to the one that loves it and be where it is happy. the point isnt what you want or what she has done but what your mother wanted and whats best for her dog.

Ideally you should get the dog, but unless there was specific provision in a will concerning the dog, you are probably out of luck.

You should get the dog back if she doesn't want to give it back 1st ask her nicely and explain why you want the dog back and how much the dog means to you, if she doesn't give the dog back then steal her dog and say her dog ran away!! HAHA
