What do you mean how is this fair. He is selling it as the drug. He is engaged in the act of holding the item out to be an illegal substance. Totally fair. He's an idiot and a criminal and should get locked up.

Obviously he was selling it as crack. He's profiting off the drug trade, only he's defrauding addicts. He's a lowlife. That's what the law is there for. To protect all. Including the buyers getting ripped off by your friend who thinks he can make money off their "disease".

it's not fair to the person that gets caught because they are out to use the drug users and when they get caught by the popo and catch a charge they think just because they were not sailing the real thing that the popo should just let them go,but that's not the way the game is played and those are the breaks didn't your friends mother ever tell him if you play with fire you will get burnt. She what I mean he was playing the drugdiller roll and know he has to take the drugdillers charges also

It's called sales in lieu of. And yes, you can go to jail for selling fake drugs. If they represent the product as drugs, they're good to go.

I have run across a few crooks who tried to sell rock salt as crystal meth. In the dark, the tweakers couldn't tell the difference.

What is the charge, selling wax? There has to be more to the story. You don't go to jail for selling wax. But the druggies he sold to might want a piece of him.

Just offering to sell it, and claiming it was an illegal drug of some sort is the offence, in the UK anyway.

It's called trafficking in a placebo controlled substance. It's illegal and it could get you hurt, more than the police charge.
