Human rights, yes. Civil rights? No. Civil rights are only for the citizins and LEGAL aliens in this country, and maybe for the people who have diplomatic immunity. The Constitution was written in America, for the (American) people and by the (American) people.

Of course they are human beings..any 3 year old can tell you that. The operative word here is illegals. If they should get civil rights as an American..then by God..they need to study, learn English, pay taxes, follow our laws and quit sending all their money home to bring more illegals over here! I am sorry..this is such a sore point with me. When they use my tax dollars to live here scot free and send their kids to our schools for free and do not pay taxes and seem to be immune to facing punishments in the legal system..that makes me want to play Annie Oakley and do a Survivalist dance on their heads!
Everybody has a right to live free..do not try to live free over my rights, however because I am an American born and raised and my belief in Democracy can stretch just so far!

Nice freakin' hot-potato topic. Yes, they need at least due process.
Here goes...
Can you really blame them for trying to improve their lives by coming to the greatest nation that provides that opportunity.
The first European settlers came to this land for just that reason - for freedom and a better life.
Too bad the natives at the time didn't have the option to refuse them any rights and successfully repelled their advance.
Then we wouldn't be a nation. Stealing their land wasn't against any law then, but it was immoral and illegal now.
Moreover, our constitution states all men are created equal under the law. Now if America wants to go around the world forcing its moral high-ground on other countries, then it has to swallow that same pill and extend rights to meekest above and beyond what the second greatest nation would do.
Anyway, who besides the Indians are actually from here. Oh, that's right, half the Mexican-American population.
Remember, land from Texas to California was part of Mexico prior to the Spanish-American War. A war the US would not wage today due to its current moral high-ground.
So, you can't have it both ways cuz' nobody trusts someone who talks out of both sides of their mouth.

According to the U.S. Constitution, particularly, the Bill of Rights, all people have inalienable rights -- God-given-- which are not to be taken away. Of course, this is sometimes conditional. For instance, you have the right to "Life" but you can also be sentenced to be executed for a crime.
Illegal aliens don't have all of the civil rights a legal US citizen has, nor should he. However, everyone should be extended basic human rights.

What civil rights are you talking about?
There are some rights in the constitution reserved only for citizens. And some reserved only for citizens or lawful residents (including lawful visitors).
But there are many other things we call rights that aren't defined as rights. Rather they are defined as limitations on government action. For example, Article 1 Section 10 Habeas Corpus, or 5th Amendment Due Process, or all of the 6th Amendment rights that apply to anyone accused by the government.
These so-called rights are actually restrictions placed on government action, not rights granted to citizens or residents, and as such apply to anyone regardless of their immigration status or citizenship.
So, it really depends on what you're talking about.

I don't think they should. They are criminals. If they show no intention of becoming legal, why should they get to enjoy the rights that are intended specifically for United States Citizens? It's BS and the ACLU crowd knows it.

Yes they should be treated like HUMANS, but not like LEGAL AMERICAN CITIZENS. It just goes back to kintergarden, if you cut in line you go allll the way to the back, i think they should not be denied opportunity, but that they should be sent back to decide if they have what it takes to do it the legal way. we should not just forgive them and let them jump in front of all these immigrants that are being legal about being citizens, we dont need any more 8 children families whose mothers and fathers are willing to work for 2 dollars an hour, it's dangerous for one, and it's hurting our economy NOT HELPING as some would like to think...

They need those rights. Without them they would all have to learn English, not be able to vote unless they were citizens and in English, couldn't bust education budgets by losing bilingual education, and would not be able to have thier Latino Congress in LA next month to target areas of society they want to make more mexican and less American.
That's just off the top of my head.

They can have all the rights they want - in their own country. They are not citizens here so they have no rights. The citizens of this country have worked and died for our rights. Illegals only work here then take the money back to their own country. And while they're here they cost us a fortune in freebies.

For the same reason that Americans who come to their countries and break their law deserve civil rights. Take Lori Berenson, for example. She's accused of terrorism in Peru and is doing life imprisonment after a legal trial, and all her civil rights were respected despite the fact that she contributed with the murder of hundreds of Peruvian civilians.
