If you made no physical contact with the other car and there are no witnesses that you can rely on then it is considered to be a solo accident. Ergo, you are at fault. How else can they proceed? If they had some one else to blame they would love it, because that person's insurance could pay the bills. But if you cannot provide any information on the other car that is specific enough to identify them then you are holding the smelly end of the stick..

Do you have any witnesses? Our daughter had the same problem, except she did the cutting off. The witnesses said the other guy was speeding. She was found 70% at fault. Check on witnesses. Both parties got tickets by the way.

i know i've heard it's always the rear enders fault because your not supposed to be following close enough to be able to hit someone,in your case not much info here so all i can say is if it wasn't your fault then it is not right,the insurance company also has it's own reponsibilities to itself and it's stockholders though,i'm sure they try to be as fair as possible
