Well Applying the penalty (whipping 100 lashes) has many rules
Before whipping :
1. There must be 4 witnesses that saw the adultery happening
2. No need for witnesses if he confessed that he committed the adultery
3. Whipping must not be on certain part of his body only but it must be spread on all the parts as not to injure him several
4. Do not hit in the head or the private parts
5. The hitter must not raise his hand more than 90 degrees as not for the lash to be so strong
6. No Binding or tying
7. The Adulterer could were some clothes but not to thick
8. The whip must not be too new to cut into his flesh or too old as not to feel it at all
The 100 lashes is not to kill but to discipline only and this punishment is for both males and females

If both muslims admit and others can confirm that they have been involved, death (in true honesty who would admit to it knowing the consequence?). All sexual intercourse out side of marriage is illegal.
Messenger? if someone catches them having hanky - panky and they deny it, the messenger has to find proof (mostly witnesses). If he does not then they are not punished, since there is nothing then to punish them for. The fallse messenger may then get punished for lying.
Unfortunately, some religious scholars now days don't yet permit DNA evidence. This limits convictions of rape and incest. Also it limits on justifications of adultery. I think the main example of that is the woman in Nigeria who was convicted of fornication since she was not married and was with a child. The man on the other hand found a couple of buddies who swore that he never had intercourse with that woman. DNA was not used to confirm that he was actually the father of the child. She got convicted, he did not.

The punishment
"If any women commits fornication , FOUR people must be witnesses against them. if they bear witness, detain them in their homes until death releases them or Allah ordains another procedure for their case."
PS: Get a life
(The law of Islam is less volitale then America. Four, not one, people must witness the act for any kind of conviction. If it is ony one person, they women can't be convicted. See how merciful God is. He makes it almost impossible for someone to be convicted.)
How Women are to be treated
Sura 4 Ayat
You who have belief, it is not halal (allowed) to inherit women by force. Nr may you treat them harshly so that you can make off with a part of what you have given them, unless they commit an act of flagrant indecency. Live tougether with them correctly and courteously. if you dislike them, it may be that you dislike something in which god has placed a lot good.

Ironic isnt it..,however it is not the men it is the women who are punished and it is also permissable for men to have sex with other men..,my dad was in Turkey for many years and I have read a book about an Islamic Muslim woman that came to the states to escape the savagery of the treatment of women.

well, stoning and beheading seem popular for what in the west would barely be a misdemeanor. so, one can only imagine. sharia is tough, but then, every culture has to be respected, right? :-)
