Does anyone have any knowledge about the immigration law? The INS will not allow his wife to come to this country at all. Now he has to hire an attorney to fight this. They won't even put her on the waiting list. Is there some problem the U.S. has with Mexico besides the illegal immigrants?

They definitively need an immigration lawyer. The reasons why someone would not be allowed to apply por permanent residency, if they are married to a US citizen are called "excludability reasons". (1) criminal record considered seroius by INS, (2) prior deportation and she was not waited outside yet the time ordered to (5, 10 or 20 years depending on when and how many times deported) , (3) She is on a list of aliens that pose a threa to the USA (sometimes you get put on that list by mistaken identity!!!), (4) some contagious illness (like HIV, TB..), (5) she has committed fraud against the government before or committed some other offense/mistake, (6) the husband does not make enough money to show he can support her in the USA without her becoming a "public charge" (welfare) and he does not have anyone to sign "an affidavit of support" saying they will become financially responsible ( sort of a co-signer when you want to buy a car but don't have enough money).
Some of the "mistakes" can be fixed if you are granted a "waiver" (pardon) by the INS but the INS has no obligation to tell you how to fix your immigration problem and probably won't. That is why you need a lawyer. If your friend has no idea the reason why the wife is being excluded his lawyer shoudl start by doing a search under "FOIA" (Freedom of information Act) so that INS is forced to give them a copy of her file!! Was she ever deported in the past?That would
be the only way they could turn her down.You know I wouldn't doubt it if they were just doing that to be mean.That is such a horrible thing to
keep loved ones separated like that.I knew a
woman who was an illegal but she had her son here in the U.S. but when the baby was only a year old they deported her and wouldn't let her take her son with her.So he had to stay and her other family members had to take care of the child.

No, not besides that. They need to ask immigration for their reason. Surely they have one.

Jenn - that is nonesense. They wouldn't let her stay if she were illegal, but they would certainly let her take her child. The state doesn't want to take care of the child. The parent has to find someone to do it.

Well yeah.. the American people want the illegals to go home... above all else, NAFTA needs to be abolished...

And I'm sure the I.N.S. have more than 1 good reason why she's not allowed in.
