im divorced to my 1st wife in phil. but now im 1 week married to my 2nd wife she's a us citizen.

if 2nd wife applies for you and the kids to have visa's only, if the mother agrees for them to leave the country they are in, otherwise that is kidnapping.
this application can take some time
seek a laywer... your case is not common.... but dont take them out of the country or you can be sent to jail if you don't have permission.

I'm not sure of the question. Did you marry a Filipina and have four children in the Philippines; and now you live in the USA and have married an American citizen? And what is your nationality, and the nationalities of the children? And why do you think that you, a man, will get custody and not you ex-wife, their mother?

Your best chance at custody is to pay your ex and her family enough money so that they sign the papers transferring custody to you. They might do that, knowing that the kids will grow up educated and rich in the USA. But perhaps not. And if not, there's not a great deal you can do about it. See a Philippine lawyer; perhaps he can help; or use judicial or government contacts (and money?) to resolve the problem in your favor.

But I don't think the law, or The Hague Convention on Child Abduction, is in your favor.

If you are a citizen and your kids are under age and the gov.in phil. let them out you can bring them here and apply for the residence, however if you are not a citizen of the USA you have to wait approx. 2 to 5 years to be able to bring them here permanently in the mid time get them a visa an bring the for vacations Don forget to send them back or they become Illegals

Who did you have the 4 kids with if not your first or second wife?


Nevermind.

They have to be the citizen's kids as I understand it. Adoption might be possible, but their mother might object.

Once your petition comes through, you will be able to request for GC status for your children. You are in the very early stages of the process.....
