sold an r.v., he defaulted, after 6mo of non payment had a court order to pay in full or return. it was returned. can i go to small claims for the 6mo owed? it is under the amount allowed.

Yes. Limit in small claims is, I think, about $7500. But, you must have proof and you must have your facts down cold. You will get an order but the big problem is collecting. If he has wages and/or business you can attach. Otherwise, chalk it up to experience.

Yes. This is like someone renting your home for 6 months and not paying, then moving out. You can still sue em for the 6 months of non payment.

You can also sell it and sue them for the difference. So if you sell it for $5000 but sold it for $7000 to them, you can sue for $2000 in depreciated loss.

Is it under the amount defined as a "small" claim? Then file a claim. It isn't very complicated, so you don't need a lawyer. Be sure to include all your losses, such as cleaning it, also. You may have trouble collecting, but if you are persistent, you may get paid.

No. You got the vehicle back so you're not entitled to any further compensation unless you can prove in court that the value of the RV was reduced during the time the purchaser had it in his possession, by damage or depreciation .

small claims in Arizona-you can sue for anything. PAY IN FULL OR RETURN-meaning he obliged-he returned it. You-in all good conscience-should not sue. It would make you look like a turd.

you can go and yu may win a judgement then you have to find a way to collect it.
