When a kiss is truly unwelcome it can be prosecuted as a crime against the person. It is not handled as theft because theft is a property crime. Now that we're passed the obvious, the crime for an unwanted kiss in Georgia could be handled a couple of ways. First simple battery would come to mind, second you might make a case of sexual battery, but the elements don't quite fit and you'd have an easier time getting a conviction for the simple battery charge (intentional physical contact of an insulting or provoking nature).

The law recognizes that under certain circumstances a consumer is allowed to sample a product before making an informed decision to purchase (dating/marriage). Sampling, within limits, insures both participants a better chance at long term compatibility and satisfaction. Think of it as a more social application of a lemon law. If one doesn't like the kiss, he/she can cancel their interest in it and continue to shop.

in case you're eating soda which you haven't any longer yet paid for, a criminal case would desire to be made which you're stealing. it rather is nearly like making a mountain out of a mole hill yet technically it rather is stealing. in case you pay for it once you have drank it, it would desire to no longer be stealing, yet as quickly as I have been the landlord of the shop i could be slightly annoyed at somebody coming in and eating a soda or unwrapping a candy bar and eating it until now procuring it.

If the person they stole it from didn't mind them having it. If you think you want get prosecuted go out and try it in public from someone you don't know and wait for the police!
