this law has never been challenged, however there is one state that is exempt from this law. Which one is it and why is it exempt?

Uh, this law was massively challenged in 1861. It was called the Civil War. Technically, West Virginia is not a legal state because it was split off from an existing state; Texas never re-ratified the contitution as required after the Civil War; and Ohio was never officially ratified as a state but given retroactive status 150 years after the fact without going through the process.

Well that would most likely be my home state and that would be Texas!! The reason I believe would be the Supreme Court ruling in Texas v. White where it was recognized that secession by mutual agreement would be the way Texas could desolve State Hood.
