The Constitution would be the cop-out answer, and if the homework question is multiple choice or short answer, than definitely the Constitution.
However, let us think about how supreme of a law it is. In the event that it is determined lacking, men try to add on to it. Now, many of the Amendments have been good (i.e. 14th, Bill of Rights), but what of some of the others? The 18th Amendment fared so horribly that it required yet another amendment to revoke it. So, does the Constitution have the supreme power, or do the people who change it?
On a similar tact, the Second Amendment, now a genuine part of the Constitution, gives people the right to bear arms. While that has never been technically revoked, many states have passed so many laws that it is practically impossible to keep a gun for anything practical, except perhaps occasionally hunting. These state laws have been contested in court, and for many of them, the Supreme Court, which is supposed to interpret the Constitutionality of laws, has approved them.
So does the document have the power? Perhaps in technicality, but it is powerless against the people who can either enforce it or flaunt it.

exactly what is that you are asking? If you read the Constitution it will answer your question. The powers are divided equally (well, supposedly anyway) three ways. The exective branch (President) Judicial (Supreme Court) and the Congress (two houses)

Err...shoot him before he shoots you? Been awhile since I studied US gov. But i don't remember anything about that...
Maybe Its that all power not reserved by the constitution goes to the States/people or somehting like that.
