IF I divorced my husband, we have two daughters, and I found a good job in another state, is that capable of happening, or since we have children would I have to move close by? I have good reason why I want to leave, I just don't want to live around here, and I definitely want my children with me...

You should never move the children away from their father unless he is a danger to them. Otherwise, he needs to be part of their life. How would you like it if he had custody of your kids and moved away? You must do what is right for the kids BEFORE you do what you want. You are second on your list of priorities.
If your husband gets custody of the children, would you move to another state then? Or would you stay and find a job so you could be close to them? See, staying is a choice you can make if you wanted to.

It's possible if he allows it...doesn't have any court decision saying you can't move out of the state. You can state your reason in court if he is protesting...then the court will decide at that point. Is there any reason why the kids shouldnt be near their father?? Will they be better off with you only, in another state?
The children's well being will be taken into consideration on all accounts. I do not advise doing it without finalizing custody in court...otherwise their father could possibly complain and you could lose custody/visitation...depending upon the circumstances. Very good luck to you and your children.

Ya I think you should do that. The new breed of Family Court judges that are coming onto the benches will have fun with you.

Unless your hubby is a complete dreg, he will get a significant reduction in the amount c-support because visitation will be severely affected. YOU WANT THAT SLICE OF CAKE TO EAT TOO, DON'T YOU?
You were caught red handed were'nt you?

Depends on the laws in your state, but I think if you are going to move out of state, your husband has to agree to let your kids move with you, otherwise you're stuck in the state, and if you go ahead and take them, it could be considered kidnapping.

this is something that would have to be decided in court unless you can get your husband to agree to it.
