He is the sole living parent. He should not have any trouble getting custody if he is a regular person with a job, not in prison or doing drugs...

it doesnt matter if the mother is trying to get the child or not by him signing the birth cerificate he is that childs father and unless he gives over his rights to the mother he can get the child no problem unless the child is staying with the grandmother if she doesnt want to give the child up than he will haveto take the grandmother to court he will win for sure unless he has a bad background and the most the grandmother can hope for is visitation witch i hope he would agree with oh but he has to understand when that womans child died a peice oh her went with her so she trying to hold on to the memory through her child and he doesnt need to hold that against her shes just hurt well good luck hope everything works out

Father will always get kids if there has not been a predetermined place for them to go to. Example: You have to go through the courts for a guardianship to determin where your kids will go if you dont want them going to the other parent in the event that something happens to you.
So, if i died my kids would go directly to their dads unless i have a guardianship that states my kids will go to thier aunts to live for the rest of thier lifes.

Im not sure i understand this question fully. If you go to the court assistance desk at the court house they will be able to help you better.
good luck.

What on earth is a daughter mother? If she died, how can she try to get custody? Confusing question all around.
