Dear "Answerers",

Is there is law (USA, CA) that requires contractor/handyman to remove garbage after completion of work?

We just had small project done (room remodelling) and expected contractors to remove all contrstuction garbage upon completion - instead they asking us to pay them for garbage removal - which (IMHO) does not make sence - it should be part of project without any mentioning.

Please advise!

to cmriley1: How can you confirm that "industry standard" is to remove all construction garbage (IMHO it is - how can it be otherwise?)

Unfortunately, it's all contract law. Read the contract you signed with them and see what they're expected to do. If it says that they're supposed to remove garbage, then it's their responsability. If it says it's your responsability, then they're right in asking for money.

If it doesn't mention it, then I *believe* that they're expected to conform to what is industry standard for a non-negociated items that are reasonably expected. (You don't NEED to specify that they don't buy stolen parts, it's reasonable to expect they won't) But that may be different where you live.

Unless it was specified in the contract, you can't assume that they will take away the debris. I'm a contractor in NY... and always stipulate that getting rid of construction debris is the homeowner's responsibility (unless they request that I work it in the price by getting a dumpster... or taking it to the dump myself). You may want to check with your Town clerk to see if they can provide that info for you. Any good contractor will cover this basic need before a job starts. There's always debris when doing construction, and it costs money to remove it. This may be a lesson you've learned the hard way... but one you won't repeat in the future.
Depending on the type and amount of garbage, you may be able to have the city pick it up as part of the house garbage. That's something you'll have to check into. Just curious??? Where did he put the debris as he was working? Did he bag it? Did he pile it up outside?

Garbage removal, such as messes made by the contractor, should always be specified in the contract signed as to who is responsible for removal. Sometimes they give cheaper rates because if not in the contract, it is assumed the homeowner is taking responsibility.

this is something that sould have been gone over when you signed the contract to have the work done. i hate to say it, but now you know.
this is a shame because any respectful self employed person or business should clean up after themselves!!!!!! hope you have better luck and knowledge on your next project.
