it is breach of confidentiality ONLY if they tell someone who doesn't need to know. Now if a potential employer calls, and askes about you, they can tell them. But otherwise, it violates every privacy act i have ever heard of.

You can share whatever you like about your job history with people. The company can not share private info about you with people. Quiting is not considered "confidential" info. Being fired is something that is more private, and can not be shared. The reason for either being fired or quiting is something that is confidential due to the personal nature of it, but again, if it is YOUR information, and you are sharing it, then it is not a breach of confidentiality.

If someone is calling your former employer for a "reference," all they can legally tell them is the dates you worked there.
