I'm not convinced that there should be a hard and fast rule anywhere, because people mature at different rates. We obviously have to protect children from predators, but if a 15 yr old can have sex in one state legally and can't in another, where is the sense in that?

The Netherlands have a kind of scale, where the criminality is based on the difference in ages. A 12 yr old can have sex with another 12 - 14yr old, and it's not criminal; if the 12 yr old has sex with a 20yr old, the 20yr old is committing a crime. That type of system, with some latitude that a judge can employ based on the appearance and psychological development of the individuals seems appropriate.

However the law is written, it should be the same regardless of your sexual orientation.

In New York state, ANY person gay or not - the legal age for sex is 17. There are no separate laws or "consents" for gay people, nor should there be. There is nothing wrong with homosexuality and it has been around since the beginning of time when Eve discovered that women taste the best and know how to do it!! Adam found a guy of his own... lol... Gay sex has been around and all over the world since the earliest days. But that kind of information is concealed in....BOOKS.

Per an answer posted above, I am a gay lawyer. (Well, sort of, I just graduated from law school and haven't taken the bar yet.) The age of consent for homosexual sex should be 18, the same as heterosexuals. Making it any different would be denying equal protection and thus unconstitutional. Of course, with our courts filled with neocon judges (who, no matter what they say, are nevertheless activist judges imposing their own opinion into the law), so that could be overruled.

It's all pretty arbitrary isn't it. Some places consider a 13 year old to be capable of consent, some places it is 16 or (ridiculously) 18. Perhaps we should target those adults who engage in coercion and predation and I bet the rest would just sort itself out.

Ask a gay lawyer, then ask a straight lawyer, and find the median response based on what they have told you.

That way you have a proper legal age of consent.
