No seriously, This past Thursday at 4pm, eastern standard time, Montel Williams had about 4-5 guests on there, and all had been victimized by Child Protective Services. What I mean by vicitmized is that these were innocent folks who had their kids taken and were falsely accused of abuse and neglect, only to eventually be cleared of any wrongdoing, but it came after the kids had been taken for 1-2 years! There were no apologies or anyone held accountable for these senseless mistakes. All 5 couples had kids that were medically sick and had not been properly diagnosed, some undiagnosed at all, and because of some overzealous doctors, these families lives were ruined and did not have to be! In all of these instances, the families could not sue, because of immunity laws of their states, this brings me to ask should some/all of the immunity be released from these agencies? Would this help things? Share your opinions?

First off, any immunity for government workers is bogus as its plainly Unconstitutional. Based on the Declaration of Independence and the US Constitution as well as most state Constitutions, this is a REPUBLIC for the people and by the people and the government has LIMITED POWERS. As human beings, we each have inalienable rights and sovereign immunity. Government is accountable to WE THE PEOPLE. This government preys on the ignorance of people (see some of the ridiculously naive answers above) and has trampled on the Constitution as a result.

This can't be more glaring than Child Protective Services (CPS), which kidnaps children all over America on a daily basis and destroys countless families as a result. All these human rights atrocities are committed under color of law and for $$$money$$$ (Title IV-A federal funding under the Adoption and Safe Families Act of 1997 - ASFA). These bogus "child protectors" have no real interest in protecting children and providing services to families in need of services as is their statutory mandate.

But please don't just take my word for it or dismiss what I'm saying outright. Please visit the LIFE (Liberty Independence & Family Equality) website for an eye opening education on what CPS is really all about. The link is provided below in "Source".

Communist government encroaching private sectors.

In Colorado, it has been brought to my attention that all public service workers have "Time-Limits" and "Ceilings" to report sexual abuse. This means if a Public High school gym teacher has sex with a student (boy or girl) that the Gym teacher is held accountable for 180 days and a total monetary judgment of $50,000.00. Should the student be tramatised and wait a year till they graduate to report this violation, their rights are gone.

However, if the Gym Teacher worked at a Private School (like a boarding school) then the student can report the violation any time (even if the Gym teach is dead) the victim can sue for unlimited monetary damages.

Sounds like the Governments way to get ride of all other educators, and wipe out the private sector doesn't it???

(Colorado Law basically allows way too much protection for the Government workers while allowing the Private sector (Corporations, Small Businesses, and Mom & Pop establishments) to go belly up. UNFAIR GOVERNMENT!!!

I call Foul!!!

i do not think these agencies should have immunity of any kind i had an experience with c.p.s.after me and my family got into a car wreck me and my wife were in the hospital and had no one took look after the kids so c.p.c. took them after we got out of the hospital we had to wait a week to get the kids back then for 6 months after they did home visits thier was no reason for this we had no history with them it was a nightmare the people who lived around us thought we were bad parents or something i`m sure and the worker made it a point to tell them who she was but not why she was thier i complaned to her superviser but nothing was done was even told that if i tried to cause waves .....

They shouldn't have immunity, but the jobs they do deal with extremely touchy subjects that affect other people's lives, sometimes personally. They should be given the benefit of the doubt, but they should also make doubly sure that the decisions they make are the correct ones or they will have to pay the consequences.

It's called sovereign immunity. The state may not be sued without its permission -- usually because of a law, such as the Federal Tort Claims Act. Or because the state has bought insurance, such as automobile insurance.

Montel Williams is a television show, with a script. Please understand that it's largely fictional. When CPS does something wrong, they are held accountable.
