Not really, but the enforcement of them is. There is way too much plea bargaining going on. And letting prisoners out early for "good behavior" - How tough can good behavior be when every minute of their life in there is structured!
There are also too many sleazy attorneys out there that will get the scum bags off on a technicality. That shouldn't be allowed. They're so worried about the rights of the criminal, the rights of the victims are ignored.

Back in the day when most crimes were simply punished with executions, there was still plenty of crime. In some ways, it makes the problem worse: if a criminal thinks that nothing worse can happen to him, he has no reason whatsoever to stop or cooperate at any point. And consider the flipside - there are SOME people who can and do reform from a life of crime, and there are SOME people who are completely innocent but are nonetheless convicted.

So the question becomes one of degree. How much effort should we expend in preserving those who can be saved? Personally, I think revenge is pointless and THAT is the problem with the criminal justice system. Instead of focusing on building a new life, inmates are often inhibited in this effort by the limits we place upon them.

In the United States it is the criminals who are more protected and seemingly have more rights than law-abiding citizens. Disgusting.
